ESMA Sanctions Report: Key Compliance Lessons for Forex and CFD Brokers

Oct 16, 2026 By Jane

ESMA’s sanctions report offers forex and CFD brokers a compliance benchmark, highlighting organisational controls and client protection as key enforcement areas. Published on October 15, 2026, it reviews national enforcement across the European Economic Area in 2025.

MiFID Fines Reach €36.6 Million

Authorities imposed 264 administrative sanctions and measures under MiFID II and MiFIR, with administrative fines totalling approximately €36.6 million. These figures cover the wider investment-services framework; they are not a forex- or CFD-specific total.

Client Information and Assessments Stand Out

Most MiFID sanctions and measures concerned organisational requirements and general principles and information provided to clients. Enforcement involving suitability and appropriateness requirements also increased strongly from 2024.

For forex and CFD firms, these findings provide a reason to review internal controls, client communications and assessment processes, according to the services they provide. This is an industry interpretation of the findings, rather than a separate enforcement programme announced for brokers.

ESMA Seeks More Consistent Enforcement

Across the report’s covered legislation, authorities imposed more than 950 administrative sanctions and measures, with fines approaching €82 million. ESMA identified substantial national differences and called for greater consistency so comparable breaches produce comparable outcomes.

The authority also cautioned that sanction counts and fine amounts alone do not measure supervisory effectiveness.
