ASIC launched a consultation on November 6, 2026, proposing to extend certain foreign financial services provider (FFSP) transitional arrangements until October 1, 2027. For cross-border brokers, the proposal raises practical questions about which entity serves Australian clients and how services are managed globally. Feedback closes on December 4.
The proposed extension would give eligible providers already using sufficient equivalence or limited connection relief more time to transition. The new FFSP regime starts on April 8, 2027.
Brokers should map each service to the entity providing it and assess the relevant licensing or exemption pathway. An Australian licence held elsewhere in a corporate group should not be treated as automatically covering an offshore affiliate.
Providers intending to use statutory exemptions must notify ASIC and meet the applicable conditions.
The framework distinguishes between professional, wholesale and institutional investors. These categories should not be treated as interchangeable.
For brokers operating both retail and institutional businesses, client classification and service allocation therefore deserve separate review. The consultation does not propose a general exemption allowing overseas brokers to offer CFDs to Australian retail clients.
ASIC’s proposed conditional class relief would allow Australian personnel to support eligible services principally provided offshore to institutional investors. Conditions include a related AFS licensee, offshore financial products and activities conducted efficiently, honestly and fairly.
ASIC would consider where decisions, execution, booking, risk ownership and supervision sit.
For brokers using teams across time zones, the operational implication is to document those responsibilities clearly. An offshore booking location alone does not explain who actually controls and supervises the service.
The extension and conditional relief remain proposals, not final permissions.
Before opening an account, verify the contracting entity, its regulatory permissions and whether its services cover your client category. A group brand or overseas licence does not establish eligibility for every Australian investor. Forex and CFDs carry substantial risk.
