Unlike government bodies such as the Securities and Futures Commission (SFC), the HKGX does not possess statutory regulatory power over the broader financial market. Its council members consist of heads of various gold and silver companies who undertake functions of industry self-discipline and market operations. While it aims to enhance market transparency through electronic trading systems and blockchain technology, its regulatory independence is limited compared to official government agencies. It primarily focuses on the trading of physical gold and silver, setting rules for spot trading, and managing member conduct.
Since the HKGX does not regulate Forex brokers, its regulatory power focuses on the precious metals sector:
-Rule Formulation: It is responsible for formulating and enforcing trading rules for spot trading of gold, silver, and other precious metals.
-Member Conduct: It manages the qualifications and code of conduct for its practitioners and members.
-Market Monitoring: It monitors abnormal market fluctuations to prevent systemic risks.
-Technological Oversight: The exchange introduces electronic trading systems and blockchain storage technology to ensure that transaction coding is fully traceable, aiming to improve market transparency and international competitiveness.
-Leverage Limitations: It is important to note that while the SFC caps financial investment leverage at 20x, some gold margin companies under the exchange may offer leverage up to 100x, which differs from standard securities regulations.
To verify if a broker is a registered member of the HKGX, follow these steps:
1. Visit the official HKGX website: https://www.hkgx.com.hk/
Navigate to the "Member Information" (or similar translation for 成员资讯) section in the menu and select "Member List" (成员名单).
2. Locate the company name you wish to verify in the list.
3. Click on "View More" (查看更多) next to the company name to see detailed information, including their business status (e.g., AA, A1, A2, B, etc.) and authorized products (such as 99 Gold, Kilogram Gold, Loco London Gold/Silver).
